Covering the Suite of Pipeline Safety Regulations under PHMSA’s Office of Pipeline Safety

The pipeline industry is under heightened scrutiny by regulators, the media and the public. The NTSB highlighted aging pipelines as a concern in its 2019-2020 Most Wanted List of Transportation Safety Improvements. Likewise, Congress has ongoing interest in the safety of older transmission pipelines and in the replacement of leaky and deteriorating cast iron pipe in natural gas distribution systems. 

An Introduction to Pipeline Safety course will highlight changes in the law and explain how companies can address compliance challenges in the context of stricter regulator interpretations of current regulatory requirements and increased enforcement.

The course will dive into developing an increased awareness of the scope and content of regulations and how to best comply with those rules.

Objectives:

  • What is the scope of 49 CFR Parts 191 – 195?
  • What facilities and products are covered?
  • How are Federal and State jurisdictional boundaries determined?
  • What does compliance look like?
  • What enforcement tools can be used and by whom?
  • What sorts of civil penalties can be levied?
  • What are an operator’s options for responding to an enforcement action?
  • How do prescriptive and management-based regulations differ?
  • What regulatory provisions apply to which facilities?
  • How do reporting requirements differ for different types of pipelines?
  • What new regulations apply to both gas and liquid pipelines, and to UNGS facilities?
  • What aids and resources are available to help operators comply?

Learning Outcomes

  • Review an introduction to regulation of pipelines and LNG facilities in the U.S.
  • State the current perspective on heightened scrutiny regarding pipeline safety
  • Delineate the statutory & jurisdictional framework for (PSA) for natural gas and hazardous liquids

Gary Zimmerman, Senior Consultant, Cycla Corporation

Zimmerman has 15 years’ experience supporting the implementation of risk management, enforcement, rulemaking, and safety programs for DOT-PHMSA’s Office of Pipeline Safety. Prior to this, Mr. Zimmerman spent 27 years performing pipeline design, construction, and operations for the largest liquid pipeline company in the U.S., including onshore, offshore, domestic, and foreign operations. For fifteen of those years, Mr. Zimmerman developed and managed corporate-wide regulatory compliance, risk management, release prevention, public awareness, damage prevention, preventive maintenance, and compliance assurance programs under DOT’s pipeline safety regulations. Mr. Zimmerman has a degree in Mechanical Engineering from the Ohio State University.

Keith J. Coyle, Shareholder, Babst & Calland

Keith Coyle is a member of the Firm’s Washington, D.C. office and a shareholder in the Energy and Natural Resources, Environmental and Transportation Safety groups and Pipeline and HazMat Safety practice. Mr. Coyle advises clients throughout the United States on energy matters, but his practice focuses primarily on the regulation of pipelines and liquefied natural gas (LNG) facilities and the transportation of hazardous materials. He has significant experience working on these issues for clients in the private sector, as a former government attorney, and through his participation in industry task forces and trade organizations.
